Spain-Specific Considerations

Hiring through an EOR in Spain comes with unique requirements that not every provider handles equally well. Here's what to ask about:

14-Payment Salary Structure

Spanish employment commonly splits annual salary into 14 payments — 12 monthly payments plus two extra pays (pagas extraordinarias) typically in June and December. This is standard under most collective bargaining agreements (convenios colectivos). Confirm your EOR handles this correctly, as some may default to 12 equal payments unless instructed otherwise.

Collective Bargaining Agreements (CBAs)

Spain has sector-specific CBAs (convenios colectivos) that can override base labor law on working hours, overtime pay, salary minimums, and notice periods. Your EOR should identify and apply the correct CBA for your employee's role and sector.

Severance Liability

Spanish labor law provides strong employee protections. Objective dismissal requires 20 days' salary per year worked; unfair dismissal can cost 33 days per year. Understand who bears this cost — your company or the EOR — and whether there are deposit or insurance requirements.

Currency & FX Fees

If your company pays in USD or GBP but employees receive EUR, watch for hidden FX conversion fees. Some providers include conversion at mid-market rates while others add a 1–3% markup. Ask for the exact FX policy in your contract.

Direct Entity vs Partner Network

Some EOR providers own their legal entity in Spain (e.g., Remote), while others use a local partner firm. Owned entities typically mean faster response times and more control. Partner-network models may be fine but add a layer between you and the employee's legal employer.

GDPR & Data Protection

Spain enforces GDPR and its national supplement LOPDGDD. Employee data — payroll, health records, personal details — must be processed in compliance. Ensure your EOR has proper data processing agreements and, ideally, EU-based data storage.

How to Choose

1–3 employees

A budget provider like RemoFirst or Skuad works fine. Keep costs low while you test the Spanish market.

4–10 employees

Mid-range providers like Multiplier or Playroll offer better support and features as your team grows.

10+ employees

Consider premium providers like Deel or Remote for comprehensive features. At this scale, also evaluate opening your own entity.

Enterprise

G-P or Omnipresent offer white-glove service, dedicated legal teams, and the compliance depth large orgs require.
